1. About these terms
These terms govern use of the GardenTec website and its enquiry services. GardenTec Innovations Ltd (“GardenTec”, “we”, “us” or “our”) can be contacted at contact@gardentec.uk, +44 7543 415737 or Park Farm House, Park Road, Stevington, Bedford, MK43 7QF.
Using the website means you agree to these website-use terms. Merely browsing, sending an enquiry, requesting a quotation or booking a demonstration does not create a contract to purchase machinery.
2. Website information and enquiries
We aim to keep product descriptions, images, specifications, prices, availability, delivery, warranty and compatibility information accurate. Website material is general information and may change. Confirm any specification, attachment compatibility, delivery date and current price with GardenTec before relying on it or placing an order.
An enquiry acknowledgement or quotation request confirms receipt only. A binding sales contract is formed only when GardenTec expressly accepts an order under the applicable quotation or order terms. We may refuse abusive, unlawful, fraudulent or technically harmful submissions.
3. Orders, prices and payment
No online checkout or payment capability is active in the current public website. If GardenTec later offers an order:
- orders will be subject to express acceptance, stock availability and the final written specification;
- the applicable price, VAT, delivery charge and payment arrangements will be shown or confirmed before the customer is bound;
- full cleared payment may be required before dispatch, using the payment details and reference provided through an approved GardenTec channel; and
- material pricing or description errors may be corrected before acceptance.
Additional order-specific terms will be supplied before any future online purchase journey is activated.
4. Delivery, inspection and ownership
Any delivery date is an estimate unless GardenTec expressly agrees otherwise. The applicable order terms will state when risk and ownership pass. Customers should inspect delivered packaging and machinery promptly and report visible damage, missing items or delivery problems as soon as reasonably possible. Nothing in this section limits statutory consumer rights.
5. Cancellations, returns and refunds
Consumers may have statutory cancellation and return rights for distance or off-premises contracts. The exact rights depend on the contract, goods and circumstances. Where a statutory cancellation right applies, GardenTec will provide the required information, cancellation route and refund using the legally required method and timescale.
Change-of-mind returns
You may open packaging and inspect goods only to the extent reasonably necessary to establish their nature, characteristics and functioning, as you could in a shop. A cancellation period is not a free trial or permission to put machinery into operational use.
Where the law permits, GardenTec may reduce the refund by the actual reduction in value caused by handling beyond what is reasonably necessary. This can include assembly, fuelling, excavation or other operational use; accumulated hours; scratches, wear, contamination or damage; modification; missing parts, manuals, keys or accessories; and damaged or discarded packaging where that affects safe transport or resale value. Any deduction will reflect evidenced diminished value and will not be a penalty or automatic restocking charge.
GardenTec may inspect and document the condition, hours, completeness and serial identity of machinery before dispatch and promptly after return. Where legally permitted, we may withhold reimbursement until we receive the goods or evidence that they have been returned. The customer must take reasonable care of goods and package them safely while they remain responsible for the return.
Return costs and arrangements, including the estimated cost of returning machinery that cannot normally be sent by post, will be explained before the customer is bound. Bespoke, personalised or other legally exempt goods may have different cancellation rights.
Faulty, damaged or misdescribed goods
Change-of-mind conditions do not remove remedies for goods that are faulty, damaged on delivery, unsafe or not as described. GardenTec will assess those cases separately and provide the repair, replacement, price reduction, rejection or refund remedy—and bear return costs—where required by law.
These terms do not exclude or restrict rights that cannot lawfully be excluded.
6. Support, warranty and safe use
GardenTec offers technical, maintenance and warranty support for eligible machinery purchased from us. Warranty coverage is machine-specific and will be provided with the relevant quotation or order.
Machinery and attachments must be selected, operated, maintained and stored in accordance with their manuals, safety information and intended use. Customers are responsible for ensuring that operators are competent and that the equipment is suitable for the planned work. Unauthorised modification or misuse may affect warranty coverage, but does not remove statutory rights.
7. Acceptable use and intellectual property
Website text, images, designs, logos and other material are owned by or licensed to GardenTec and protected by intellectual-property law. You may view and print reasonable extracts for personal evaluation of our products, but must not reproduce, modify, scrape, republish or commercially exploit the website without permission.
You must not attempt unauthorised access, introduce malicious software, overload the service, harvest personal information, impersonate another person or use the website unlawfully.
8. Availability, links and liability
We do not promise that the website will always be uninterrupted or error-free. We may suspend or change it for maintenance, security or business reasons. Third-party links are provided for convenience; GardenTec is not responsible for third-party content or services.
Nothing in these terms excludes liability where exclusion would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation. For consumers, we are responsible for foreseeable loss caused by our breach. Different limitations may apply to business customers and will be stated in the relevant contract.
9. Privacy and changes
Our privacy policy explains how we handle personal information. We may update these website terms to reflect service, legal or business changes; the review date identifies the current version.
10. Governing law
These terms are governed by the laws of England and Wales. Consumers retain any mandatory rights to bring proceedings in another UK jurisdiction where applicable. If part of these terms is unenforceable, the remaining provisions continue to apply.
